Expert witness for appeals; especially for officer overturns for Local Planning Authorities

We are very happy to take on any form of appeal including Public Inquiries for Local Authorities should they have capacity issues or should they have an officer overturn at Planning Committee that they cannot deal with.

Advice on extensions allowed under permitted development regulations and submissions of Certificate of Lawfulness applications.

Preparation of evidence and statutory declaration to support development and to try and demonstrate compliance with the 4 or 10 year rule to prove lawfulness.

Agricultural permitted development rights

We advise on permitted development rights for agricultural land and buildings. We work with specialist agricultural consultants as and when required. With whom we work will depend on the specialism. The common areas tend to be for new agricultural buildings and equine related development.

Strategy for maximising development potential of sites and particularly Green Belt sites

Sometimes sites can be complex and can involve multiple areas for potential development. These scenarios often need a strategy to work out in which sequence we should promote the development.

Change of use applications

We can provide advice on potential Change of Use of buildings. These may sometimes fall within Permitted Development whereby planning permission is not required. In these circumstances, we would submit a Prior Approval or a Certificate of Lawfulness. Where planning permission is required we would work with  a client to ensure the correct information is submitted to the Local Authority.

Variation of condition applications

Where amendments to planning permission are required this can sometimes be achieved through the submission of a ‘variation of condition application’. We can advise on this process to ensure permission is achieved for changes to an already established permission. We can offer a service of clearing conditions attached to planning permissions.

Non material and material amendments to planning permissions

Occasionally clients change their minds and may seek to alter their plans. Depending on the extent of the changes we can look to regularise with the Local Authority to ensure all the changes are approved.

Enforcement cases

Advice given either prior to or following the issuing of an Enforcement Notice. The notice may be subject to an appeal. We provide a service to appeal enforcement notices as required.
