Traditionally design barn style incidental domestic outbuilding
The clients on this project wished to construct a habitable annex, games room and garage in their garden, to replace an existing brick workshop and garage building. They wanted it to have sufficient height to allow for living space within the roof void, which requires a minimum height of at least 5metres. Our Initial advice was that the Council would be unlikely to grant permission for such a large structure, given the existing outbuilding only had a height of 3.6metres.
We therefore approached this in a staged way and initially secured approval of a large 3 bay garage + workshop, using ‘Class E Permitted Development’ rights.
Once these rights had been secured a planning application was submitted to combine the two buildings, (ie existing outbuilding and proposed Permitted Development garage), and the application was submitted for the new structure with a height of 5 metres. This approach allowed us to seek permission for the additional 1.4 metres in height required to ensure sufficient head room for useable / habitable space in the roof void.
Planning permission was granted for a new building containing games room / TV room and garage at ground floor, and bedroom, bathroom at first floor in the loft void.
It is unlikely that a planning permission would have been granted for this size of building if the principle of the additional outbuilding had not been established under permitted development rights.
