The project at South Munstead Lane demonstrated a two-stage planning approach that first addressed historic constraints and then enabled new development. Originally approved in 1949 as an agricultural worker’s dwelling, the property was subject to an occupancy restriction. By securing a Certificate of Lawfulness (existing), it was proven—through evidence such as statutory declarations and tenancy records—that the cottage had been occupied by non-agricultural workers for over ten years. This established that the agricultural tie was no longer enforceable, allowing unrestricted residential use.
With this constraint removed, the project progressed to a Certificate of Lawfulness (proposed) for modest domestic expansion. The scheme included a single-storey rear extension and a detached outbuilding, carefully designed to comply with permitted development rights under the GPDO. Despite the site’s sensitive Green Belt and Surrey Hills AONB location, the proposals met all requirements relating to scale, siting, and use. The Council confirmed compliance on a legal basis, granting the certificate and allowing development without full planning permission, demonstrating how lawful use certificates can unlock and deliver compliant development opportunities.
